The foundation of most plans. A trust lets you manage your assets during your lifetime, provides for you if you’re incapacitated, and passes everything to your beneficiaries without probate.

📝 Last Will & Testament

Names guardians for minor children, directs assets to your trust, and handles anything not covered by the trust. Even with a trust, everyone needs a will as a safety net.

Names someone you trust to make medical decisions for you and documents your wishes about end-of-life care. Without this, even a spouse may lack legal authority in an emergency.

🔑 Durable Power of Attorney

Gives someone you trust the legal authority to handle your finances, pay bills, manage investments, and make legal decisions if you’re unable to do so yourself.

💰 Beneficiary Review

Your retirement accounts, life insurance, and bank accounts pass by beneficiary designation, not by your will. We make sure these are coordinated with your overall plan so nothing falls through the cracks.

A: That’s actually the best time to do it. When everything is going well and you’re not under pressure, you can think clearly and make thoughtful decisions. Get it done now, and you won’t have to think about it again until something in your life changes. Most of our younger clients say the same thing afterward: “I wish I’d done this sooner.”

A: A will goes through probate, which is a public court process that can take months. A revocable living trust avoids probate entirely, keeps your affairs private, and gives you more control over how and when your assets are distributed. Most people benefit from having both.

A: At minimum, you need a healthcare proxy, a power of attorney, and a will. Without these, the state decides who makes decisions for you and who inherits your assets. If you own a home or have significant savings, a trust may also make sense to avoid probate and protect what you’ve built.

A: We recommend reviewing your plan at least once a year, and updating it whenever something significant changes in your life.

Common reasons to update:

  • Marriage, divorce, or new relationship: Your plan should reflect your current partnership and legal status
  • New child or grandchild: Update guardian nominations, trust provisions, and beneficiary designations
  • Move to a new state: Estate planning laws vary by state, so a Massachusetts plan may not work properly elsewhere
  • Major financial change: Home purchase, inheritance, business launch, or retirement all affect your plan
  • Change in relationships: If someone you named as a trustee, agent, or guardian is no longer the right fit
  • Tax law changes: Federal and state laws shift regularly, and annual reviews keep your plan efficient

A: Not at all. If you have a bank account, a car, a retirement plan, or people who matter to you, you have enough to plan for. This isn’t about the size of your estate. It’s about making things easy for the people you care about and making sure your wishes are clear. The peace of mind alone is worth it.
